ok this is a little unusual, my exp so far has been the checks are almost always cashed within 3-4 days, call cust center or take infopass and follow up, if you have a lawyer then ask him to check on it.
However i am not sure why your application reached VSC.
We have been applying for advance parole document at NSC for the last few years.
This time also we sent our application to NSC on 01/28/2010.
However, after about 15 days, we received a receipt notice letter from Vermont service center and the case is now pending at VSC. Moreover, the check is not cashed yet.
Based on the state we are living, the I-131 application instructions specify that I-140 based applications should be sent to Nebraska service center.
I am wondering if USCIS started processing I-131 applications at VSC.
Or our application is mistakenly misclassified and sent to VSC.
Any comments?

why dont you call the head branch in USA, and ask them if you can use this degree for immigration.
Cause I have my MS from NEWPORT and when I asked them if I can ues it for my GC then they told me that it cannot be used for immigration.

Please remember here that earlier employer could use ur I140 for other employees but that rule was also changed in 2008. I140 once approved, you keep I140.
Revoking I140 is not good for employee as it is his application to USCIS in this process and will put him in problem for other employees sponsorship.
Chances are remote.

I don't understand this, we are talking about these backlogs, which are effecting about 300K - 500K skilled immigrants, and we only have about 4000 members yet. We should take this as challenge and go on to drive to speak to people like us to increase the members strength, so we will have significant backing and Senate / House / President will pay attention to what we request.

Hi all!
I've been trying to get a job offer from Canada for the past one year as my occupation is not on the list of occupations that have shortage. I'm a market research analyst and work online with a UK company for almost 3 years. I would love to move to Canada and have a real job and family but am at a stage where I do not know what else to do as the companies want you to be present in Canada and Canadian govt asks for a job offer to get a visa?
Very confused here. If someone got an arranged offer from Canada could you please guide on how much work experience you had and how you got an offer?

Why should the employer hold your salary? If you had any agreement for paying back cost of your GC processing for leaving within a certain period, that would not hold any more (since last June such agreements are illegal)
No employer will write a direct agreement, you will have to payback the GC cost - instead they execute an agreement, employee should payback all the benefits (legal fees, service fee, tuition fee and etc)extended to him, if s/he leaves before X number of months/years - which is legal. Refer to one of the posts, http://immigrationvoice.org/forum/showpost.php?p=211373&postcount=3 , which has same opinion.

My PD is Feb 2008 and my I-140 has been approved the same year. I am on my H-1b 3 yr extension.
If I were to change my job now, will I lose my PD or can the new company refile my new I-140?

Actually stay outside the country does not constitute towards bench time. So if you are outside country - you are not in bench. One American Consulting company I used to work for way back in 2001 - used to move benched candidates to Canada (if they need to be benched for long time) and then bring them back when they get a project.
Please remember that you may be asked to prove you have a project at POE so when you come back have copies of contract to prove it.

I think I know what you mean, however, I'm not sure how to do it in Swift alone.
You could do the opposite of what you want (objects together at the beginning then splitting up) import the swf into flash, then select the 30 frames and choose the 'Reverse frames' option to get the desired effect.

Hello!
My H1B got expired in Sep 2010, ( applied for transfer before expiry), got RFE and finally approval last week, but 797 form has the validity from current date(approved date) instead of requested date in Sep 2010. So now is the period from sep 2010 to 797 approved date is considered as out of status or how it is? I have paystubs during this time and on job all the time. Any implications while going for h1b stamping in India and or at port of entry and in future GC.
Any inputs are apprciated. Thanks!
If I remember correctly, you are allowed to work for 240 days from the receipt date while your case is pending. If the approval does not come within 240 days, you have to stop working and wait for the approval. You are NOT considered out-of-status as long as your petition was filed before the current H1 expired.

On June 9, 2009, U.S. Department of Homeland Security (DHS) Secretary Janet Napolitano granted deferred action for two years to widows and widowers of U.S. citizens (and their unmarried children under 18 years old) who reside in the United States, and who were married for less than two years before their spouse’s death. Deferred action is a short-term act of prosecutorial discretion that suspends removal proceedings against an individual or group of individuals for a specific timeframe. The action is temporary and it will not resolve an individual’s underlying immigration status.
