Can an eb3 with pendding I-40 apply for visa lottery? would that effect the current i-485 application if visa lottery not won? will it cause to the refusal of the I-485?

I did not know that ... So the company contracting someone has to maintain an I9 information?

I am on H1 (Has EAD but never used it), my wife is on H4 and also she has H4 stamping till Feb 2010, She got EAD and and also got SSN. But she never worked on EAD. Now she want to travel to India
Can she travel on H4 stamping or she need to get AP

I have applied I485 when i was in India and it is in pending now.I am back from India and currently in USA now and came to know that one cannot file I485 when the applicant is not in USA.
Should i be withdrawing the pending I485 and reapply now ?since there is a date availability till august 17th 2007
Or Can I appply new I485 without withdrawing the pending I485 .Once I get new receipt notice ,then withdrw the old pending I485?

Good question.
The rule is misleading and your confusion is understandable. Do not file in the CSC, it will likely be rejected, or if you're lucky, they might overlook it or transfer the case to VSC.
The filing location will be the VSC because that's your worksite. The rule requiring you to file in CSC has to do with the "H-1b employer" itself being cap exempt (ie. institutions of higher education and certain non-profit organizations). Your H-1b employer is a for-profit company, I assume, so they are not exempt from the cap.

Section 2.2 should be "e" if you're porting to a new employer, if it's a pure extension with the same employer, pick "b."

I have filed my GC from Employer A , now I have completed 1 year since I 485 is filed. I have an offer from empyer B who is ready to transfer my H1B. Now my current H1B is expiring in Nov and I will be completing my six year in nov itself. If I go with employer B I am not sure for how long my H1B will be extended. Please advise suitable process for this.
I believe you should be using your EAD + AC21 after 6 months of filing 485.

In general, AP is not related to employment (it is a conditional admittance aka parole into US boundaries till the conditions are resolved), so the PoE CBP should not ask about employment. However, as your husband has been away for a long time, the CBP officer may be curious to know why and what is the purpose of entering US after such a time lag.
In such a scenario, your husband should have a strong reasoning as to why he is entering US. Some of such reasons are a) employment b) having immediate family in US or c) owning house/property that needs visitation.
If your husband has one such reason, it may be helpful to gain entry into US, but pl do consult your lawyer...good luck

This is simple posturing and nothing more. Hispanic caucus CANNOT bring down healtcare reform. They have as much invested in the healthcare bill as anybody else in the Congress. They way I see it, this equates to a sucide threat if my friend won't shot at the enemy. Hello,
My labor got approved couple days ago and my employer would like to file I-140 without using an attorney. I have few questions, it might seem simple to you but I am confused:
I am a software engineer and labor approved for SOC 15-1032, what should be filled in the nontechnical description of job field? For H1B, my company listed duties of the position on the cover letter for this question, should it be the same way for I-140?
Anyone has sample template of the cover letter?
My company has not filed tax returns for the last quarter, will the returns of second last quarter do? I have W-2 which is substantially higher than the proffered wage.
Since I am earning more than the proffered wage should that be filled under "wages" on I-140 or the offered wage mentioned on perm?

Following is the situation:
My H1 (6 years) expiring on 7th Mar'08 (have 35 days of vacation might be good till 11th Apr'08)
Labour filed on 06/20/2007 , still awaiting..(so 365 days rule does not apply for 7th yr ext)
Spouse was on H4, got H1 in Oct'2007 (no stamping done for H1).
Falling short of 10 weeks to get the 365 days rule
Options that I learnt for me getting 7th yr extension and staying in the country:
Option1:
Convert to H4 toward the end of H1 6 yrs expiry date till June 20th(to get the 365 days rule in effect)
File for 7th year extension based on the 365 days rule
Convert from H4 to H1 and start working.
Option 2:
Get Canada working visa (not sure how long it will take to get though) and work till June 20th there (to get the 365 days rule in effect)
File for 7th year extension based on the 365 days rule
Stamping in canada to return to USA.
(I am hoping 7th year extension can be done while I am outside the country)
Option 3:
Go back to India for 3 months wait till June 20th,
File for 7th year extension based on the 365 days rule
Stamping in India to return to USA.
(I am hoping 7th year extension can be done while I am outside the country)
Option 4:
Leave for India immediately and stay there for 10 weeks and recapture them along with 7th year extension(while I am in India )

I saw a prior post talking about this issue but has no answer. I am very upset about it.
Vermont Center received my OPT Application on Oct 31,2008. But I checked my status online and it said, "Your case can not be found at this time in Case Status Online. Please check your receipt number and try again. If you need further assistance please call the National Customer Service Center at 1.800.375.5283."
Could anyone who experienced this could tell me why? (I inputted the case number correctly.) Can you guys still get your OPT card after this happened?

I want to extend the stay for my Parents for few months. They are on visitors visa. I am aware that I need to file form I - 539 for this purpose. I am not sure what reason should I specify for extention?
If some one had done extention for visitors visa in past please, I would appereciate your help on this.
