I need to re-file my I-485 application which was rejected due to USCIS error (they could not find I-140).
Can anybody tell me what is the logic behind writing "DO NOT OPEN IN THE MAIL ROOM" on envelope while re-submitting I-485 appplication?
I will need to send to USCIS today. Please let me know ASAP.

Why would you even consider this at this point. After 8/17, everyone will be U, so who knows when you get to even file if you wait. You want to tack on 6months to your wait (and thats being generous), and them pay more money?

An unconfirmed sources of information has just released a report that the Sen. Bill Frist, Majority Leader is pushing a two-week full Senate floor debate beginning from March 20, 2006 rather than March 27, 2006. This report is indirectly supported by another news that the Senate Judiciary Committee is pressed to extend their additional mark-up on Friday, March 17 to finish up the Committee action before the end of the week.
Looks like things are heating up and an Immigration bill might get passed sooner than expected!

Hi guys,
My H1-B visa is approved lastyear (Jan 2007).and I came to US on Mar 2007.
In my H1-B visa the DOB is wrongly entered.In my passport the DOB is correct.I havent checked this and i m in US now.When i went to Driving office to apply for my drivers license they asked me to correct the DOB in my VISA.
Can anyone helpme out how to change correct my DOB in my H1-VISA.
Whats the procedure to change my DOB in my Visa.
Any help is appericiated.

Had a quick question. Not sure if this has been discussed before. Planning to get wife here on H4 and she wants to study. I have applied for 485 and in retro now. Is it advisable to study on H4 or F1? I know she can work on F1 but would that not be advisable since lets say the VB does become current in future for me then filing her 485 might be a problem since F1 is pure non immigrant and USCIS might hold it againt her. Any info/simlar situations greatly appreciated.

You can only work on an F1 under OPT which can only be applied for after at least two full semesters of studying or after graduation.
The F1 is not purely a non immigrant visa since this is the one people like my son are transferring to since they aged out of the employment based immigration system. If it were this would not be possible.
An H4 is as good as any choice if she plans to study. The fees will depend entirely on the state and the educational institution she chooses to attend.

However, if my experience with slashdot is anything to go by, we wont get any sympathy from fellow (US citizen/GC) techies there .. they have been brainwashed into believing that we actually stole their jobs ... in any case their opinion does not matter much. the Company is given guidelines by the lawyer and USCIS and they need to follow those guildeline. I am not interfering. I just want to know if what they did would satisfy the requirements of the PERM recrutiment process. Not sure why you gave me a red dot for this. I spoke to another Border Post official and he suggested that i drive uptp the nearest border and they would refuse my entry to Canada as i don't have a valid visa and i can turn around and come back to US and i can get a new I-94. Do you think it would be safe to do this ?
Any advices?
If you have travelled to Canada in May even if you have a single entry visa into Canda, you are more likely to be let into canda than refused. On the way back if you ask they might issue you a new I-94, strictly speaking they don't have to unless you have stayed some period (I don't know the exact period) out side the country.
Most parents coming to US on visitor visa and wanting to stay in us for more than 6 months apply for new I-94s(extension), just because attempting to cross the border does not give them a new I-94.

Yes. First I-140 should be cleared for you to port your PD to the second I-140.

if your LLC is sponsoring your GC petition, then it is not possible. Your EAD will have certain conditions for employment, usually in the same line of work as the Labor Cert. Unless of course if you are a dependant EAD, then there are no restrictions on your employment opportunities.

The prudent thing for you to do is to go back to your home country, and come back with a proper VISA.

If the petition is approved under Consular Processing then they need to leave the country. Other wise no. The reason for Consular Processing would be not maintaining the status continuously.
If you get I94 along with the approved H1B then you are fine. If not, you need to leave the country and get it stamped. Your other friends might have not got I94 along with their approved I94
